Does the Xbox 360 Elite have this problem?
If so what is the best placement of the Xbox 360 Elite, horizontal or vertical, I will keep it on a very stable surface, well ventilated and very cool.

Yes, it still scratches the disk if you move it while the disk is spinning. Look in the manual. It specifically tells you not to move it.
The most stable position is horizontal because more area is in contact with the surface, plus you can’t tip it over like you could with the vertical position.
No, just make sure you put the disk in carefully- meaning it fits smoothly in the disk tray- and it’ll work just fine.
I don’t use any cooling fans and our Xbox is fine.
